Terms of Service

Last updated 9 September 2026. These terms are a contract between you and Sea Otter Inc. for the product at seaotter.dev. They are not terms for seaotter.ai (OtterScore).

The service

SEAOTTER is managed hosting for Hermes Agent: isolated agents, a control plane, and related dashboards and APIs. Current regions, backups, and what we do not claim as an SLA are on /trust. Features, prices, and limits can change.

Accounts

You must provide accurate information and keep your credentials (including GitHub, Google, X, and agent dashboard passwords) under your control. You are responsible for activity on your workspace and agents. One person or organization per account unless we agree otherwise in writing.

Acceptable use

Do not use SEAOTTER to break the law, attack other systems, send spam, mine cryptocurrency, or interfere with other customers. Do not probe or overload the control plane. We may suspend or delete an account or agent that creates risk for the platform or other tenants.

Trials and billing

Published prices and the 7-day trial are on /pricing. Trials do not require a card; paid plans are billed through Stripe. Fees are generally non-refundable except where the law requires otherwise. You pay any taxes that apply. Customer model-provider usage (BYOK) is billed by that provider, not by us.

Your data and keys

You retain rights in the content and keys you put on an agent. You grant us a limited license to host, back up, and process that material only to run the service. You must have the rights to the content and keys you upload. How we handle personal data is in the Privacy Policy.

Availability and liability

The service is provided as is. We do not warrant uninterrupted or error-free operation. Trust describes current hosting and backup posture; it is not a service credit SLA. To the fullest extent allowed by law, Sea Otter Inc. is not liable for indirect, incidental, special, consequential, or lost profits damages, and our total liability for a claim is limited to the fees you paid us in the 12 months before the claim (or $100 if you paid nothing).

Termination and law

You may stop using the service and ask us to delete your account. We may terminate for breach, non-payment, or platform risk. These terms are governed by the laws of the State of Washington, USA, excluding conflict-of-law rules. Exclusive venue is the state or federal courts in King County, Washington, unless applicable law requires otherwise.

Changes

We may update these terms by posting a new version on this page. If a change is material, we will update the date above. Continued use after the update means you accept the revised terms.
